2. Collection and use of personal data

For improvements in favor of the user, MEET5 processes personal data. This is done with appropriate notices and the consent of the persons concerned. Personal information provided by you on these pages may include name, gender, address, age, phone number, e-mail address, user ID, password, geolocations, photos (if uploaded by the user), dating preferences, restaurant category, hobbies, transaction information and any other information that may be provided by the user in the future through MEET5 functionalities.

Connect functions of third party providers such as Facebook Connect are offered as an option for registration with MEET5. When registering via connect functions of third party providers, the user agrees to the respective terms and conditions of these third party providers and further agrees that certain data from the respective profiles of the user are transferred to the MEET5 database.

In addition to the information you provide (which includes data you may enter during registration and in your profile such as email, name, job, gender, date of birth, description, interests, current residence/location, relationship status), information may be collected during your visits to the MEET5 app:

  • Application Information: We collect information about your activity on MEET5, such as time of use, clicks, profile views, interactions with other users, time spent in the app, etc.

  • Device information: device ID, device type, app settings, app crashes, advertising IDs, version and language, operating system, time zones.

  • Other: if you let us access your location, we will collect your exact geolocation using GPS, Bluetooth and Wifi connection. The determination of your geolocation may also take place in the background, even if you do not use MEET5, if the permission you have given us explicitly allows such collection.

The provision of your data is generally voluntary. If data is mandatory, it is noted in the registration mask or can be seen from it. The mandatory provision of certain data is necessary to ensure the purpose and nature of MEET5 and the safety of users (e.g. verification of the authenticity of a user, matching age groups, interests to find suitable users for meetings). In this respect, MEET5 can only be used if certain information is provided. If you do not agree with this, you are asked to refrain from using MEET5.

MEET5 uses common tools (see 9. Use of automatic data collection methods) for automatic data collection. These tools collect certain standard information that your smartphone sends to us. For certain emails sent by MEET5, MEET5 may also use some of these tools for automatic data collection. These tools collect information when you open the email or click on a link contained in the email. To collect information, MEET5 also uses commercially available sources that are deemed reliable. Information obtained in this manner may include name, address, email address and demographic information. Information obtained from these commercial sources may be used in conjunction with information collected by MEET5 from your visits to MEET5 websites.

When using the website for information purposes only, we collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data on the basis of legitimate interests to this extent, which are technically absolutely necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f DSGVO): IP address, date and time of the request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, amount of data transferred in each case, website from which the request comes, browser, operating system and its interface, language and version of the browser software. The data is stored in log files and is not merged with other data. The data is regularly deleted after one month at the latest.

4. Transfer of personal data

Your data is mainly used to provide you with a good experience on the MEET5 mobile app. Personal data is mainly seen by other users to interact with you on MEET5. We share some user data with service providers (such as newsletter service providers for newsletter delivery, Groove for support) because we need these services to conduct business.

The operator of MEET5 uses the services of third parties (hereinafter referred to as "partners") to enable and maintain the operation of the online services offered by MEET5 (e.g. hosting, customer support, email providers). In certain cases, personal data must be transferred to these partners. As far as possible, the operator of MEET5 will transfer this data in anonymized form. The partners of the operator of MEET5 are contractually obligated to treat personal data, which they receive from the operator of MEET5, confidentially and to use it exclusively for the services claimed by MEET5.

Your data may also be passed on to partners who support us in the distribution and marketing of our services. For example, we may share limited information about you in non-readable (hashed) form with advertising partners.

Before we engage any service provider or work with any partner, we conduct a rigorous review process. All of our service providers and partners must agree to strict confidentiality obligations.

Except as described in this statement, MEET5 will not share your personal information with third parties without your express permission, except for the following purposes:

  • In response to lawful requests for information by law enforcement or government authorities;

  • in compliance with any law, regulation, subpoena or court order;

  • to prevent fraud or to enforce or protect MEET5's rights and property; or

  • To protect the personal safety of MEET5 employees.

Circumstances may arise for strategic or other business reasons under which MEET5 decides to sell or buy, merge or otherwise restructure. Such a transaction may involve the disclosure of personal information to prospective buyers or purchasers or the receipt of such information from the seller. MEET5 may disclose your information in the event of a change of ownership/control, provided that such buyers or prospective buyers agree in writing in advance to maintain appropriate confidentiality.

5. Data protection for minors

MEET5 does not knowingly collect any data from minors (persons under the age of 18), and the MEET5 app is not directed at minors. We recommend that parents and guardians take an active role in their children's online activities and interests to protect them.

6. Your choices and privacy settings

MEET5 provides you with a choice as to whether you receive a variety of product information. You may subscribe to certain product and service specific information or to general communications from MEET5.

You may make or change your choice to receive subscribed or general communications at the time of data collection or by any of the methods set forth in the following sections. This option does not apply to communications or notifications that are not primarily promotional. These include notifications about contracts, support, or other administrative or transactional notices. The email messages you receive from MEET5 will be sent in accordance with this statement.

  • Automatic messages

  • General Notices

MEET5 keeps its users informed of events, products and services through push notifications. This includes, but is not limited to, information about new products or special offers.

7. Your rights

MEET5 strives to ensure that the personal data stored is as accurate as possible. To this end, MEET5 has implemented technologies, procedures and policies. MEET5 allows individuals, within reason, both access to the personal data they have provided to MEET5 and the ability to review and, if necessary, correct or request anonymization, blocking or deletion of that data. To protect your privacy and security, we also take appropriate measures to verify your identity - for example, by asking for your birthday date, entering a password and user ID - before we allow access to your data. To view or change the personal information you have provided directly to MEET5, you may go to the MEET5 App where you originally entered the information and change and, if necessary, delete the information there.

By law, you have the right to review, request information about, and update your stored personal data (Article 15 of the GDPR).

- Review of your data: Data protection rights give you the right to review personal data we have stored about you. You can download a copy of your personal data by pressing here and logging in with your MEET5 credentials. If you do not have access data because of Facebook login, please write us a message from the e-mail address stored in your profile, indicating your name and birthday.
- Updating your data. If you believe that data we hold about you is incorrect or we no longer have the right to use it and would like to request its correction or deletion, or object to its processing, please delete your account in the app or write us an email from the email address with which you are registered with us at support@meet5.de.

To protect your data, we may ask for proof of identity before sending it to you.

The data protection law also stipulates further data subject rights, which we would like to inform you about as follows:
You have a right, if applicable, to rectification or deletion as well as restriction of processing, objection to processing (see more detail on this below) as well as data portability.
You also have the right to complain to a data protection supervisory authority.
You have the right to revoke a declaration of consent under data protection law at any time with effect for the future.
Right of objection pursuant to Art. 21 DSGVO: If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) lit. f DSGVO, you have the right to object to the processing of your personal data with effect for the future pursuant to Art. 21 DSGVO, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which will be implemented by us without specifying a particular situation.
If you would like to exercise your right of revocation or objection, an e-mail to support@meet5.de is sufficient.

8. Security of your personal data

It is important to the operator of MEET5 to prevent unauthorized or unauthorized access to the personal data processed by the operator of MEET5. For this purpose, the operator of MEET5 uses certain technologies and technical protection measures. The transmission and collection of personal data takes place via SSL (Secure Sockets Layer) encryption. The systems used by the operator of MEET5 are secured by means of firewalls, among other things.

We do our best to protect your data. Nevertheless, we cannot guarantee one hundred percent security. Please always pay attention to which data you disclose in which context and especially to which persons.

If you suspect that your data is no longer secure, please notify us immediately at: support@meet5.de.

9. Use of automatic data collection methods

While using any of MEET5's online services, information may be collected through certain automatic data collection methods, such as cookies and other common mechanisms. This includes, but is not limited to, browser-specific data and data reflecting usage patterns in the MEET5 APP. This data is collected by MEET5 for analysis and improvement purposes, among others. If MEET5 collects personal data as a result, this is done on the basis of the legal provision.

  • Session Data of the MEET5 APP

  • Cookies/Use of Cookie Data

  • Session cookies: When visiting the MEET5 website, data is stored in the user's browser for a short period of time, which is deleted again when the browser is exited.

  • Mobile Cookies: cookies may also be used when using MEET5 via a mobile web browser.

The MEET5 website and app use analytics services if the user has consented. These may use "cookies" and session files that are stored on your computer or smartphone and that enable an analysis of your use of the website. The information generated by the cookie or session files about your use of this website (including your IP address in anonymized form) is transmitted to a server of the service provider and stored there. The information is used to evaluate the use of the website or app, to compile reports on website activity for website operators and to provide other services related to website activity and internet usage. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

For the purpose of analyzing user activity, MEET5 uses the services Amplitude (https://amplitude.com) of Amplitude, Inc., 201 Third Street, Suite 200, San Francisco, CA 94103, USA, and Google Data Studio (https://datastudio.google.com) of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The following information in particular may be processed as part of the analysis: User ID (Randomized 16 digit number), gender, age, current geo-location, activity in the app such as usage time, clicks, profile views, interactions with other users, time spent in the app), device properties (such as type, device ID, device type, app settings, app crashes, advertising IDs, version and language, operating system, time zones), mobile carrier.

MEET5 relies on the processing of this data because MEET5 is a very regional community platform and it is necessary to find out in which region how many users in which age and gender group are active. In this context, a community can only develop if enough like-minded people of the same age can be found to engage in group activities. Without this information, community managers cannot look after the regions because they do not even know what is happening there.

For the purposes of analyzing the effectiveness of advertising campaigns, MEET5 uses the services Google Analytics (https://analytics.google.com) of Google LLC, AppsFlyer (https://www.appsflyer.com) of the company of the same name based in San Francisco, California, USA, and Facebook SDK (https://developers.facebook.com/docs/app-events/) of Meta Platforms, Inc. group, USA.

The measurements are necessary because the community always needs new members, which are acquired through advertising campaigns. Without effective advertising campaigns, the cost of a new user is too high to keep MEET5 running. MEET5 depends on knowing whether, for example, an advertising campaign about "hiking" in the "Ruhr area" has been successful, or whether the topic is generating less interest and potential users need to be approached in other ways.

Note on data transfer to the USA
Where possible, data is stored in data centers in the EU. At the same time, it cannot be ruled out for all service providers used that data may also be transferred in whole or in part to the USA. For the USA, there is currently neither an EU adequacy decision nor any other suitable guarantees for DSGVO-compliant data processing. Therefore, if data is transmitted to the USA, there is in particular the possibility of access by US secret services. The use of such tools, for which we request your consent, is therefore based on your voluntary decision. The permissibility of the transfer is then based on your consent in accordance with Art. 49 (1) a DSGVO or on the basis of EU standard contractual clauses, which we conclude with the service providers in the USA as part of the agreements for order processing. If you do not agree with the use, we ask you not to consent to it and to refrain from using the services.

The operator of MEET5 reserves the right to commission additional comparable service providers in the future and/or to replace existing service providers with others, provided that this does not result in any significant deviations from the functionalities and associated data processing described above.

10. Services for customer loyalty and communication

For purposes of appropriate and adequate customer services, MEET5 uses the services Groove (https://www.groovehq.com), SendGrid Transactional, Send Grid Marketing and Braze.
Groove is used to ensure first-class support, such as when sending an email to MEET5's operator support team, and then to properly process and respond to the support request. SendGrid is used, among other things, to send system emails to inform users of new activity related to their profile (e.g., "You have a new message"). Via the marketing function of SendGrid, the operator of MEET5 sends news and information about activities and products of MEET5. By means of Braze, user-specific push messages, email newsletters and in-app content are communicated such as automated birthday greetings or notices of matching events in MEET5 based on overlapping interests of the users.
In principle, the User may object to the use of his e-mail address for advertising purposes at any time without incurring any costs other than the transmission costs according to the prime rates (Section 7 (3) UWG); in this case, however, the operator of MEET5 shall at the same time be entitled to immediately discontinue the provision of services to the User, as the provision of the information is absolutely necessary in order to provide a proper service.
The operator of MEET5 reserves the right to commission other comparable service providers in the future and/or to replace existing service providers with others, provided that this does not result in any significant deviations from the previously described functionalities and associated data processing.

11. What is the procedure for deleting data and creating backups?

With the deletion of your user profile (Attention: Not by uninstalling the MEET5 app) or corresponding notification to the operator of MEET5 (support@meet5.de), all collected data of the user will be deleted. Excepted are data that must be retained due to legal regulations or for contract execution or enforcement of claims or for legal defense.

The user can delete his account or individual data in the profile himself at any time. A deletion from the user interface of MEET5 takes place immediately. However, the deletion from all server layers, cache memories and backup databases of MEET5 may take up to 14 days.
MEET5 reserves the right to check profile files prior to deletion and, if necessary, to back them up if, based on certain facts, there is a suspicion that the user profiles are in violation of the law or the contract. This serves to protect other users and to protect the interests of MEET5 worthy of protection.
The operator of MEET5 creates so-called backups to secure the data stocks, which are overwritten after 7 days in each case and thus finally deleted. As far as these backups contain log files, these will also be deleted. In case of complete deletion of a user profile, the log files will also be deleted.

12. Changes to this statement

If we make changes to this privacy statement, we will post the revised statement here with the current revision date. If we make fundamental changes to this statement, we may also notify you by other means, such as by email or by posting a notice on our home page.

13. Declaration of consent

By completing and thus confirming the registration dialog in the course of registration, the user confirms that he/she has read this privacy policy and agrees to it.
